Dation in payment: what it is, when banks accept it and the consequences

Mortgage dation in payment is an agreement with the bank: you hand over the property to the lender in exchange for settling the debt, either fully or partially. It is not an automatic right of the debtor. It is an exceptional solution that the creditor can accept or reject according to its policy and your file.
It is mainly considered when there is no viable buyer at market price, or when the outstanding balance clearly exceeds the value of the property and an open-market sale cannot be completed without a prior agreement.
How it differs from a standard sale and a debt write-off
In a property sale with a mortgage, you look for a private buyer and use the purchase price (plus additional funds if necessary) to settle or transfer the mortgage. In a debt write-off, the bank reduces the balance so that the sale can be completed. In a dation in payment, the bank keeps the property: there is no private buyer involved in the transaction.
Sometimes dation in payment is combined with a partial debt write-off (you hand over the property and a remaining debt still stands). Other times, a full cancellation is agreed. It depends on what the lender signs.
When banks usually consider it
- Proven financial hardship (defaults, lack of liquidity, ongoing repossessions, or risk of enforcement).
- Property value lower than the outstanding balance, with little prospect of a quick sale at a sufficient price.
- A fully documented file: debt, income, assets, and a clear proposal.
Just because it "makes sense" to you does not mean the bank will accept it. Each entity has its own criteria and there is no single legal timetable that obliges them to grant it in all cases.
Consequences worth considering
You lose the property
It is obvious, but it needs to be stated plainly: you cease to be the owner. If your goal is to stay in your home, dation in payment is not the route; you would need to look into mortgage restructuring or other options.
Residual debt
If the agreement does not cancel 100% of the loan, you may still owe a remaining balance. Read the document thoroughly: "dation" does not always mean a "clean slate".
Credit and asset impact
A dation in payment usually leaves a mark on your financial history. We do not invent universal "penalty" timeframes: the specific impact depends on how the transaction is registered, solvency registers, and the policies of future lenders. Ask for advice based on the specifics of your case.
Tax implications
There may be tax implications (for example, related to debt cancellation or the property transfer). The exact position depends on your circumstances and applicable regulations. Tax or legal guidance is recommended before signing, not after.
Before requesting it
Partial dation in payment and other nuances
Not all dations settle 100% of the debt. Sometimes you hand over the property and sign an acknowledgement of residual debt, a payment plan, or a partial write-off on the remainder. Check whether guarantors remain liable and whether the lender releases you from future legal actions regarding that loan.
It is also worth comparing this with an assisted sale involving a debt write-off: if there is a buyer at market price, settling via a private sale (even with a balance reduction) can result in a cleaner outcome than handing over the keys to the bank. There is no single answer: it depends on liquidity, urgency, and lender policy.
- Compare it with an orderly sale (with or without a debt write-off): sometimes you maintain greater financial standing and, if there is equity, recover some liquidity.
- Request in writing the balance and the conditions that the bank would put on the table.
- Check whether there are guarantors or other guarantees: transferring the property does not always release all involved parties automatically.
- Do not sign under the pressure of verbal deadlines without a written document.
