I have inherited a VPO property in Madrid: can I sell it?

Inheriting a VPO property in the Comunidad de Madrid does not automatically make you a seller ready to sign. First, you need to settle the inheritance and understand which protection restrictions remain active. After that, you can decide whether to sell under the subsidized housing scheme or consider disqualification.

The short answer is yes, you can sell it, but the sequence matters.

Step 1: inheritance and registration

Until the property is awarded and registered in the name of the intending seller, the sale becomes complicated (or simply unviable in standard notary practice). Accepting the inheritance, dividing the estate if there are multiple heirs, settling inheritance tax and completing the land registry entry must all come before listing the property online.

If there are multiple co-heirs, reaching an agreement on the price and the future of the property is just as critical as navigating the VPO status.

Step 2: understand your protection status

The inherited property may still be subject to official protection. Check the official classification, title deeds and land registry extract (nota simple). VPO, VPPB and VPPL properties are managed differently when it comes to transferring ownership or applying for disqualification.

Do not assume that "inheriting automatically releases the property". Protection does not vanish simply because the previous owner has passed away.

Step 3: sell under the scheme or apply for disqualification

  • Sale subject to protection: potential price caps and buyer eligibility limits, alongside administrative procedures where required.
  • Disqualification: if your goal is the open market and the file permits it, subject to any requirements (including the potential repayment of subsidies) specific to your case.

Processing times for disqualification vary depending on the housing regime, public subsidies to be repaid and documentation required. There is no single timeline for all heirs in Madrid.

Subsidies and debts: review them early

If the property received state subsidies, these can affect the sale or disqualification process. It is also essential to check Council Tax (IBI), community fees and any outstanding mortgage. Inheriting the property does not erase existing encumbrances.

Common mistakes after inheriting a VPO property

  • Listing at open-market price without verifying the housing regime.
  • Signing a deposit agreement (arras) while the property remains in the deceased person's name.
  • Ignoring a co-heir and subsequently halting the signing process.
  • Confusing deadlines or regulations from other autonomous communities.

When joint professional advice is recommended

Inheritance combined with protected housing is where generic advice often falls short. It typically requires legal expertise (estate allocation, taxes) and administrative guidance (protection status / disqualification), as well as commercial insight if the ultimate goal is to sell.

At Sky Real Estate, for the social housing aspect in Madrid, you can start with VPO / VPP disqualification. If your situation involves a complex inheritance alongside a sale, we align this with our group's legal support so nothing is signed prematurely.
